50% from deposit paid will be refunded with a notice period no less than 180 days prior to the day of delivery for service or product.

Payment Schedule

To secure a booking with this vendor, please pay a 50% deposit via Aiido. The deposit paid will be released to the vendor after the service/product is delivered.

Remaining balance of payment will be collected by the vendor - 50% of total payment as booking fee

Terms and Condition

It is agree that the following terms set out the total agreement made between the parties and that no variation of modification of this contract shall be effective unless agree by both parties in writing.

Booking Fee

The booking fee of 50% secures the date, time and service of SHUTTERING HEARTS is nonrefundable or transferable in the event of cancellation it being the agreed loss suffered by the photographer(s) due to cancelation. Booking fee to be paid no later than 10 days upon confirmation of service or else SHUTTERING HEARTS reserve the rights to decline the contract as and when deem required.

Date Changes/Cancellation

The retainer fee is non-refundable. Cancellation made within 8 weeks before the wedding will result in payment in full. All cancellation must be in writing. Weddings/ Pre-Weddings that are postponed to a later date (within 6 months) will retain the same package fee provided that the photographer(s) is still available on the new date. An administration fee of MYR400 will be chargeable for postponement. Further postponement of date (more than 6 months) will be considered the same as cancellation.

Display

SHUTTERING HEARTS may use any images included in this contract in their studio or other business premises such as web site, Facebook, blog, portfolio, literature, display areas, exhibition, competitions, advertising, slide show or commercial. Digital files remain the sole property of SHUTTERING HEARTS. Credits should be given back to SHUTTERING HEARTS should the client decides to use any of the images for non-commercial public display (ie. magazine or website features).

Editing

All photos provided will be edited based on minor color, contrast, brightness, hue, saturation and some artistic black and white conversion. Major editing such as facelift, skin smoothing, eye bag removal, modification on physical appearance and etc in not inclusive in the package unless specified and agreed by SHUTTERING HEARTS with extra charges applicable depending on the extent of editing done on case by case basis.

Album Design

Clients will be asked to select up to:

40-50 images (Pre-Wedding Half Day)

60-80 images (Pre-Wedding Full Day)

50-70 images (Actual Day Wedding Half Day)

80-100 images (Actual Day Wedding Full Day)

for the standard 40 pages album. Based on the number of pages in the album selected in your package, not all images selected will be put in the album. The number of images put in the album will be between 30-50(Pre-Wedding Half Day) 50-80 (Pre-Wedding Full Day) and 50-80 (Actual Day Wedding Half Day) 80-120 (Actual Day Wedding Full Day), and will vary by design of the album. Clients will have the option to add more pages for an additional charge. Clients are asked to mark images that must appear in the album.  

Album Design Layout

The layout of the album design will first be sent to Clients for confirmation prior to print. Revision of the album design layout is limited to only twice (2). Additional admin and editing charges of RM 200/ revision applicable for revision request more than twice (2).

Attendance

In the unlikely event of the appointed photographer being unable to attend your wedding due to unforeseen circumstance due to sickness or in an event of accident, we reserve the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his / her best ability provided with the agreement from the client.

Limitation and Liability

In an unlikely event of a total photographic failure or cancellation of this contract by either party in any other circumstance, the liability of one party to the other party shall be limited to the total value of the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. Neither party shall be liable for consequential loss.

Cancellation

The client may cancel this contract at any time by giving sufficient notice to SHUTTERING HEARTS but in doing so shall forfeit any payment made. Cancellation in less than 8 weeks before wedding date will result in the payment in full.

Payment

Following payment of 50% booking fee, the remaining 50% balance of fees due to be paid upon completion of the shoot. All payment will be made in either cash, internet banking or check payable to SHUTTERING HEARTS.

Delivery Time

All photos and artwork will require a certain timeline for further editing and touch up. The maximum agreed timeline would be as follows:

1) Actual wedding day reception = 3 months

2) Pre-wedding   = 2 months

3) Portraiture   = 3 weeks

*For express editing there will be a RM 500 surcharge with turnaround time of 2 weeks

The above agreed timeline is only applicable for delivery of montage and edited high resolution images only.

Booking of Location

Venue reservation and arrangement for shoot shall be the responsibility of the couple. The booking fee and additional props rental such as cars, decors and ets shall not be covered as part of the package.

Force Majeure

The due performance of this contract is subjected to alteration or cancellation by either party owing to any cause beyond their control.

Photo Archival

The Client is responsible for the archival and safekeeping of photos delivered. All photos will be deleted or sent for archival within 3 months after the photos are delivered to The Client.
